It seems like we have been constantly writing about bank holidays recently and now a further Bank holiday has been proclaimed in honour of the coronation of His Majesty King Charles III. Rishi Sunak, Prime Minister has decided to proclaim an additional bank holiday to mark the Coronation of His Majesty King Charles III in 2023.
The Bank Holiday will fall on Monday 8 May 2023, following the Coronation on Saturday 6 May.
By way of reminder, there is no legal statutory right to a bank holiday.
The question of whether employees are entitled to this additional day will depend solely on their contractual entitlement i.e. what the employer has agreed to provide.
There is no right to the extra Bank Holiday and it will be up to the business whether to provide it if the employer has said: ‘You are entitled to 28 days holiday inclusive of bank/ public holidays.
If the employer has said: ‘You are entitled to X days holidays in addition to bank/ public holidays.’ then the Company has contractually agreed to it and there is an entitlement to an extra day off.
Don’t forget that that latter also applies to those employees that work on a part time basis who will be entitled pro rata.
Most employees like to plan their annual leave in advance so will probably start asking questions soon about entitlement to this additional Bank Holiday.
